AUSTIN, Texas – Austin’s Billboard laws made it to the US Supreme Court.
The judges will hear a case in the City of Austin, Texas on Wednesday against Reagan National Advertising of Texas Inc. over a city ordinance banning the use of digital billboards in an off-site location.
The regulation prevents billboard companies from converting existing signs into digital ones for aesthetic and safety reasons. The case before the Supreme Court concerns the broader issues of freedom of expression.
In this particular case, Reagan National Advertising of Texas Inc. sought permission to digitize 84 billboards outside the building and sued the city when the permits were denied according to Supreme Court files.
The Supreme Court will consider whether the city law’s distinction between on-site and off-site signs under Reed v Town of Gilbert is unconstitutional.
Before going to the Supreme Court, the Fifth Circuit ruled that the First Amendment invalidated the contested provisions, stating that the Reed v Town of Gilbert distinction between on-premise and off-premise is content-based and the The court file says that she does not pass a strict control test.
